• To generate AI content (songs, artwork, artist profiles) on your behalf using prompts you provide.
• To send transactional emails: account confirmation, password resets, purchase receipts.
• To send product updates or promotional emails — you may opt out at any time.
• To detect and prevent fraud, abuse, or violations of our Terms of Service.
• To improve the Service through aggregate, anonymised analytics.
• To comply with legal obligations.

We do not sell your personal information to third parties.

When you use our AI generation features (song creation, artwork, artist DNA), the prompts and parameters you provide are sent to third-party AI providers (Replicate, Suno, or similar). These providers process your input to generate content. We store the resulting content on your behalf but do not claim ownership of it. You retain rights to the content you generate, subject to the terms of the underlying AI provider and our Terms of Service.

Prompts you submit may be used to improve our platform in anonymised, aggregated form. They are never shared with other users or sold to third parties.

We share your data only in the following limited circumstances:

• Service providers: Supabase, Stripe, Cloudflare, Replicate — strictly to operate the Service.
• Music distribution: If you choose to distribute via DistroKid, the artist name, song title, and relevant metadata are shared with DistroKid.
• Legal requirements: When required by law, subpoena, or to protect rights, property, or safety.
• Business transfers: In connection with a merger, acquisition, or sale of assets, under confidentiality protections.

We retain your account and content data for as long as your account is active or as needed to provide the Service. If you delete your account, we will delete or anonymise your personal data within 30 days, except where retention is required by law or for legitimate business purposes (e.g., fraud prevention records, financial transaction logs).

We use strictly necessary cookies to keep you signed in (session cookies) and preference cookies to remember your settings. We do not use third-party advertising or tracking cookies. You can disable cookies in your browser settings, but the Service may not function correctly without session cookies.

The Service is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal data, contact us at privacy@imaginethissound.com and we will delete it promptly.

Depending on your location, you may have the following rights:

• Access: Request a copy of the personal data we hold about you.
• Correction: Request correction of inaccurate data.
• Deletion: Request deletion of your personal data ("right to be forgotten").
• Portability: Request your data in a machine-readable format.
• Objection / Restriction: Object to or restrict certain processing.
• Withdraw consent: Where processing is based on consent, you can withdraw it at any time.

We implement industry-standard security measures including encrypted connections (TLS), hashed passwords, and row-level access controls in our database. No method of transmission over the internet is 100% secure; we cannot guarantee absolute security but we take reasonable precautions to protect your data.

ImagineThisSound is operated from the United States. If you access the Service from outside the US, your data may be transferred to and processed in the US, where data protection laws may differ from those in your jurisdiction. By using the Service you consent to this transfer.

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the new policy on this page and updating the effective date. Continued use of the Service after changes constitutes acceptance of the updated policy.
